Welcome to Darling Evelyn. These Terms of Service govern your access to and use of our website and your purchase or use of products, classes, tutorials, kits, digital materials, and other services offered by Darling Evelyn.
By visiting our website, placing an order, registering for a class, purchasing digital content, or otherwise using our services, you agree to these Terms of Service. If you do not agree to these Terms, please do not use our website or purchase our products or services.
1. ONLINE STORE TERMS
By using this website, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have permission from a parent or legal guardian where required.
You may not use our products, website, classes, tutorials, digital materials, or services for any unlawful or unauthorized purpose.
You may not attempt to interfere with the operation or security of our website or use our website in a manner that violates applicable law.
2. HANDMADE PRODUCTS
Many Darling Evelyn products are individually handmade.
Because of the handmade nature of our work, slight variations in bead placement, wirework, shape, color, measurements, crystal appearance, stone appearance, and other details may occur.
These variations are part of the handmade character of the product and are not necessarily considered defects.
Colors may also appear differently depending on lighting, photography, screens, monitors, and device settings.
3. ONE-OF-A-KIND PRODUCTS
Products identified as one of a kind are individually created and may not be reproduced.
Unless otherwise stated, when a listing identifies an item as one of a kind, the customer will receive the specific item pictured.
Once a one-of-a-kind product has sold, Darling Evelyn is under no obligation to recreate or reproduce that design.
4. NATURAL MATERIALS
Some Darling Evelyn products may contain natural stones, crystals, pearls, shells, minerals, or other naturally occurring materials.
Natural variations in color, pattern, inclusions, texture, transparency, shape, and size are expected and are not considered defects.
5. PRODUCT AVAILABILITY
All products are subject to availability.
We reserve the right to limit quantities, discontinue products, modify designs, or remove products from sale at any time.
Placing an item in your shopping cart does not reserve that item. An item is not considered purchased until checkout and payment have been successfully completed.
In rare circumstances involving inventory errors, duplicate sales, payment issues, or other circumstances preventing fulfillment, Darling Evelyn reserves the right to cancel and refund an order.
6. PRICING AND PAYMENT
Prices are displayed in the currency indicated on our website and may change without notice.
We reserve the right to correct typographical errors, pricing errors, product descriptions, promotions, discount errors, or other inaccuracies.
Payment must be successfully completed before an order is considered confirmed unless Darling Evelyn has expressly agreed to another arrangement.
Discount codes and promotions may be subject to additional restrictions and may not be combined unless expressly stated.
7. PREORDERS AND PRESALES
Products identified as preorder or presale items are purchased before they are ready to ship or before the applicable service or class has taken place.
Any estimated production, fulfillment, or shipping timeframe is an estimate and is not a guaranteed delivery date.
Handmade production schedules, material availability, carrier delays, order volume, and circumstances outside our reasonable control may affect estimated timelines.
By purchasing a preorder or presale product, you acknowledge and accept the stated estimated fulfillment period.
8. SHIPPING
Customers are responsible for providing a complete and accurate shipping address.
Darling Evelyn is not responsible for delays resulting from incorrect or incomplete shipping information supplied by the customer.
Once an order has been transferred to the shipping carrier, transit times are controlled by the carrier and cannot be guaranteed by Darling Evelyn.
Estimated delivery dates provided by Darling Evelyn, Shopify, shipping carriers, or other services are estimates and are not guaranteed unless expressly stated otherwise.
Customers should contact us promptly regarding packages that appear damaged, missing, or otherwise affected by a shipping issue so that we can determine what assistance may be available.
Nothing in this section limits any rights or remedies that cannot legally be waived.
9. RETURNS, REFUNDS AND CANCELLATIONS
Returns, refunds, exchanges, cancellations, and store credits are governed by the Refund Policy displayed on our website and any product-specific terms clearly disclosed at the time of purchase.
Certain handmade, custom, personalized, made-to-order, one-of-a-kind, digital, class, tutorial, or presale purchases may be final sale where permitted by law and when disclosed before purchase.
Nothing in these Terms eliminates any consumer right that cannot legally be waived.
10. CLASSES AND WORKSHOPS
Darling Evelyn may offer live, prerecorded, or otherwise scheduled classes and workshops.
Dates, times, formats, required materials, attendance instructions, and other class details will be provided in the applicable listing or communication.
If a customer cannot attend a live class, any alternative access, recording, private video link, rescheduling option, or other accommodation will be governed by the terms stated in the applicable class listing.
Purchasing a class does not transfer ownership of the class curriculum, design, recording, teaching materials, or other intellectual property.
11. TUTORIALS AND DIGITAL CONTENT
Tutorials, instructional videos, class recordings, patterns, guides, photographs, written instructions, and other digital materials provided by Darling Evelyn are protected intellectual property.
Unless expressly authorized in writing, digital materials are licensed to the purchaser for personal use only.
Customers may not copy, reproduce, redistribute, upload, publish, resell, share, transmit, record, screen-record, commercially distribute, or make Darling Evelyn’s instructional content available to another person.
Access links intended for an individual purchaser may not be publicly posted or shared.
12. KITS
Craft kits may contain small pieces, beads, wire, crystals, findings, tools, or other components.
Kits should be used for their intended purpose and in accordance with any provided instructions.
Unless specifically identified as appropriate for children, kits and their components are intended for adult use or appropriate adult supervision.
Small components may present a choking hazard and should be kept away from young children and pets.
Wire, tools, glass, crystals, and similar materials may contain sharp edges or break if improperly handled.
13. PRODUCT SAFETY AND INTENDED USE
Darling Evelyn products are decorative unless expressly identified otherwise.
Suncatchers should be securely installed and periodically inspected to ensure they remain safely attached.
Glass, crystal, beads, wire, hooks, chains, and other components may break or become damaged if dropped, struck, improperly installed, or subjected to excessive force.
Products should be kept away from small children or pets when they contain small, fragile, sharp, or detachable components.
Customers are responsible for using and displaying products appropriately and according to their intended purpose.
14. SUNLIGHT AND SUNCATCHERS
Suncatchers are designed to interact with natural light.
Customers are responsible for choosing an appropriate and secure location for displaying their suncatcher.
As with any glass or crystal object exposed to sunlight, customers should use reasonable care regarding placement around heat-sensitive, delicate, or potentially flammable materials.
15. CARE AND AGING OF HANDMADE PRODUCTS
Handmade jewelry, wirework, crystals, beads, metals, and decorative pieces may naturally change in appearance over time.
Metals may oxidize, tarnish, patina, discolor, or otherwise change depending on environmental conditions, humidity, oils, chemicals, cleaning products, storage, and handling.
Normal aging, tarnishing, patina, or wear resulting from use is not necessarily considered a manufacturing defect.
16. INTELLECTUAL PROPERTY
Unless otherwise stated, all content associated with Darling Evelyn, including original product designs, photographs, videos, graphics, illustrations, written materials, branding, logos, class materials, tutorials, instructional content, website content, and other creative materials, is owned by or licensed to Darling Evelyn and is protected by applicable intellectual property laws.
Nothing in these Terms transfers ownership of Darling Evelyn intellectual property to the customer.
Purchasing a physical product does not grant the purchaser ownership of the underlying design, photographs, instructional content, branding, or other intellectual property associated with that product.
17. COMMERCIAL USE OF DESIGNS AND INSTRUCTIONAL CONTENT
Purchasing a Darling Evelyn product, kit, class, or tutorial does not automatically grant permission to reproduce, teach, distribute, license, or commercially exploit Darling Evelyn’s protected instructional materials or other copyrighted content.
Any commercial license or permission must be expressly provided in writing by Darling Evelyn.
Nothing in this section is intended to claim exclusive rights over ideas, techniques, functional methods, or other material that is not protectable under applicable intellectual property law.
18. CUSTOMER CONTENT
If you voluntarily submit photographs, reviews, comments, testimonials, messages, or other content to Darling Evelyn, you represent that you have the right to provide that content.
We will not claim ownership of your original content solely because you submitted it to us.
Any use of customer-submitted content for marketing or promotional purposes will be subject to applicable law and any permissions required under the circumstances.
19. REVIEWS AND COMMUNICATIONS
Reviews and communications must not contain unlawful, threatening, defamatory, harassing, fraudulent, obscene, or infringing material.
Darling Evelyn reserves the right to moderate or remove content from areas we control where reasonably necessary to protect our website, customers, business, or legal rights.
Nothing in these Terms is intended to prevent customers from providing truthful reviews, making lawful complaints, reporting concerns to government agencies, or exercising legally protected rights.
20. FRAUDULENT TRANSACTIONS AND CHARGEBACKS
If you believe there is a problem with an order, we encourage you to contact Darling Evelyn so that we have an opportunity to address the issue.
Darling Evelyn reserves the right to dispute chargebacks or payment disputes that we reasonably believe are inaccurate, fraudulent, abusive, or inconsistent with the transaction records.
We may provide relevant order information, tracking information, customer communications, applicable policies, proof of delivery, and other transaction records to payment processors, banks, Shopify, or other entities involved in resolving a payment dispute.
Nothing in this section prevents a customer from exercising legitimate rights available through their payment provider or applicable law.
21. REFUSAL OR CANCELLATION OF SERVICE
To the extent permitted by law, Darling Evelyn reserves the right to refuse or cancel orders or services in cases involving suspected fraud, abusive or threatening behavior, repeated misuse of store policies, security concerns, unlawful activity, or other legitimate business reasons.
If we cancel a paid order before fulfillment for one of these reasons, any refund owed will be handled in accordance with applicable law and our policies.
22. THIRD-PARTY SERVICES
Our website may use or link to services provided by third parties, including Shopify, payment processors, shipping carriers, social media platforms, and other service providers.
Darling Evelyn does not control all third-party websites or services and is not responsible for their independent practices, availability, content, or policies.
Use of third-party services may be subject to separate terms and privacy policies.

We make reasonable efforts to provide accurate product descriptions, photographs, pricing, availability, and other website information.
However, occasional typographical errors, technical errors, omissions, or inaccuracies may occur.
Darling Evelyn reserves the right to correct errors or update information as reasonably necessary.

To the fullest extent permitted by applicable law, the total aggregate liability of Darling Evelyn for all claims arising out of or relating to the website, products, services, orders, classes, tutorials, kits, digital materials, or these Terms shall not exceed the total amount actually paid by the applicable customer to Darling Evelyn during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
27. INDEMNIFICATION
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Darling Evelyn and its owner, employees, agents, affiliates, contractors, and representatives from and against third-party claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising out of or relating to:
• Your misuse of our website, products, services, kits, classes, tutorials, or materials
• Your violation of these Terms
• Your violation of applicable law
• Your infringement or violation of another person’s rights
• Content or materials submitted by you through our website
This provision does not require you to indemnify Darling Evelyn for conduct for which indemnification cannot lawfully be required.

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms, this website, or products or services offered by Darling Evelyn shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.
To the extent permitted by applicable law, legal proceedings arising from or relating to these Terms shall be brought before a court of competent jurisdiction in the State of Georgia.
Nothing in this provision eliminates a consumer’s rights under laws that cannot contractually be waived.
32. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law or severed as necessary, and the remaining provisions will remain in full force and effect.
33. NO WAIVER
Failure by Darling Evelyn to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision or any other provision in the future.
34. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any additional terms disclosed in connection with a particular product, class, promotion, or service, constitute the agreement between you and Darling Evelyn regarding your use of our website and purchases from us.
If product-specific terms conflict with these general Terms, the more specific terms disclosed to the customer at the time of purchase will control to the extent of that conflict, subject to applicable law.
35. FORCE MAJEURE
To the extent permitted by applicable law, Darling Evelyn will not be responsible for delays or failure to perform caused by circumstances reasonably beyond our control, including severe weather, natural disasters, fires, transportation interruptions, carrier disruptions, power or internet outages, governmental actions, labor disruptions, supply interruptions, or similar events.
This provision does not affect obligations or consumer remedies that cannot legally be excluded.
